I desire to participate in the Savannah Community Association’s (the “Association”) sponsored 5k Walk/Run event (the “Event”.) In conjunction with my participation in the Event, I hereby freely, voluntarily, and without duress execute this Release under the following conditions:
1. In consideration of the opportunity to participate in the Event, I hereby release and forever discharge, hold harmless and covenant not to sue the Association and its directors, officers, agents, volunteers, or employees (collectively, the “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any of the property belonging to me WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise, (a) while participating I the Event; (b) while in, on or upon Association property; and (c) while in transit to or from the Event or in any place or places connected with the Event which arise or may hereafter arise from my participation in the Event.
2. I understand that this Release discharges the Releasees from any liability or claim that I may have against the Releasees with respect to any bodily injury, personal injury, illness, death, or property damage that may result from my participation I the Event. I also understand that the Association does not assume responsibility for or an obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance.
3. I am fully aware of the risks involved and hazards connected to participation in the Event, including but not limited to travel risks and risks of injury while on Association property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or any loss or damage to property owned by me, as a result of participation in the Event or while in transit to or from the Event or in any place or places connected with the Event, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise.
4. I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage or costs, including court costs and attorney fees, that they may incur due to my participation in the Event, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise.
5. I understand that the Association does not maintain any medical or health insurance policies for individuals who participate in the Event. As such, I am aware that I should review my personal insurance portfolio, especially accident/medical coverages.
6. It is my express intent that this Release and Waiver of Liability (this “Waiver”) shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named Releasees. I hereby further agree that this Waiver shall be construed in accordance with the laws of the State of Texas.
IN SIGNING THIS WAIVER, I ACKNOWLEDGE, REPRESENT, AND WARRANT THAT (a) I have read this Waiver, understand it and sign voluntarily as my own free act and deed; (b) no oral representations, statements, or inducements, apart from this Waiver, have been made; (c) I am at least eighteen (18) years of age and fully competent; and (d) I execute this Waiver for full, adequate and complete consideration fully intending to be bound by the same.
